In June of 2011, I met Bert for the first time after taking over the case from a previous attorney. His son, David, had been brutally abused by David’s maternal grandparents. Bert was fighting tooth and nail to bring David home to live with him, but the grandparents weren’t giving up that easily.

After Bert became aware of the abuse, he sought Legal Aid Society’s help and we began working diligently to bring his son home. Bert told us the horrors of David’s abuse. His maternal grandparents were chaining him up like a dog, starving him, and not allowing him to go to the bathroom. When David was admitted to the hospital, the abuse was so bad that the doctor admitted him as a “John Doe” so that the grandparents would not be able to locate David. David was in the hospital for six days; his system was so backed up from not being allowed to use the bathroom, feces were found in his nasal cavities and throat.

The custody battle raged for months until finally a settlement was reached in favor of our client, Bert. David now lives with his father and his younger siblings. David plays T-Ball and has caught up to the average child his age. Legal Aid Society, Inc. is proud to be a part of this miracle of reunification and wishes nothing but the best for Bert and his family in the years to come.

In December of 2011, “Mary” contacted Women’s Protective Services requesting assistance with an ex-boyfriend whose harassing behavior had escalated to the point that is was affecting her workplace, forcing her boss to petition the national, corporate headquarters for permission to block the abuser’s phone number so that he would no longer be able to call their office constantly and tie up the business’ lines. After the relationship had become violent and the abuser had injured her jaw by forcing his fist into her mouth during a fight, Mary had cut off all contact with the abuser, but he rented and moved into a duplex across the street from the house she owned and neighbors had seen him walking around her house and looking into the windows, both at times that she was not home and at times when she was home alone. Mary decided to take action. She was referred to the Legal Aid Society of Lubbock through Women’s Protective Services and we filed and obtained first an Ex-Parte Protective Order and then a final Protective Order for Mary. During the course of our representation of Mary on this matter, we discovered that her abuser had been convicted and had even served time in prison for serious domestic violence-related crimes on two previous occasions with two previous relationships and we feel that Mary took appropriate and early action in seeking a protective order and this may have saved her life.
Abby and her father came in to see me about filing a Sexual Assault Protective Order. Abby had been sexually assaulted by her 19 year old half brother and her father, Jim, was the father of both children. Immediately we contacted the District Attorney’s office and worked with them to attain Abby an Emergency Protective Order since the abuser was incarcerated. Once we attained the EPO, we filed the SAPO and set it for hearing. We were able to retain the Sexual Assault Nurse Examiner and Jim as witnesses. The Rape Crisis center sent over one of their counselors to aide Abby as she sat and waited. We tried our hardest to make sure Abby didn’t have to be put through any more trauma then she had already experienced. When I arrived that morning for the hearing, the abuser agreed to the SAPO and signed the Protective Order. The abuser is waiting to see if he will be indicted on the sexual assault charges, but we hope the Sexual Assault Protective Order will aide in this process.
